ARTICLE 1 – FIELD OF APPLICATION
These General Terms and Conditions of Sale ("GTC") are applicable, without restriction or reservation, to all sales concluded by the company "#CorporateName#", whose registered office is located at #Address#, registered with the commercial court of under the number #CompanyNumber#, represented by #LegalRepresentative#, (hereinafter « the Seller »), with consumers or non-professional buyers (hereinafter "the Customer"), wishing to acquire the funeral products for sale on the website www.enaos.fr (hereinafter "the Site").
These GTC govern exclusively the sale online of funeral products (urns, tablets, flowers, etc.) and are not supposed to regulate the supply of funeral services, to which a distinct and regulated quote is applicable.
ARTICLE 2 – OBJECT
The purpose of these GTC is to define the conditions under which the Seller sells funeral products to Customers via the Site.
ARTICLE 3 - PRE-CONTRACTUAL INFORMATION
The Client acknowledges that, before placing the order, they had received information about the essential characteristics of the products, the total price including tax, the payment and delivery methods, as well as their right of withdrawal.
ARTICLE 4 – PRODUCTS
The products offered are those featured on the Site. They are described and presented as accurately as possible. However, there may be slight differences, particularly in floral compositions or natural materials.
Personalised products (e.g. engraved plaques) are made to order on request and according to the information provided by the Customer.
ARTICLE 5 – PRICE
Prices are expressed in euros, all taxes included (TTC). The processing and shipping fees are confirmed before the order is validated.
The Seller reserves the right to change its prices at any time, but agrees to apply the rates in effect at the time of the order.
ARTICLE 6 – ORDER
Any order placed is deemed complete acceptance of the customer to these GTC.
The Client must:
- Select the product(s) you want;
- Complete your personal information;
- Process your order and payment;
- Receive an order confirmation by email.
ARTICLE 7 – PAYMENT
Payment is made in cash when the order is placed, by credit card, via a secure payment system.
ARTICLE 8 – RIGHT OF WITHDRAWAL
8.1 Non-perishable Products
In accordance with Articles L.221-18 and following of the Consumer Code, the Client has a period of 14 days from receipt of the goods to exercise their right to withdraw without having to justify their decision or incur any other costs than the return costs.
8.2 Exclusions
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply:
- To products manufactured according to consumer specifications or clearly personalised;
- To perishable products (natural flowers, etc.).
ARTICLE 9 – DELIVERY
Products are delivered to the address stated by the Customer as part of the order. The Seller undertakes to ship within 3 days.
In the event of a delay, the Customer may cancel the order in accordance with article L.216-6 of the Consumer Code.
ARTICLE 10 - LEGAL WARRANTY
The Seller is required to:
- the legal guarantee of conformity (articles L.217-3 and following of the Consumer Code);
- guarantee of hidden defects (Articles 1641 and following of the French Civil Code).
In case of a defect or non-compliance, the product may be repaired, replaced or refunded according to legal provisions.
ARTICLE 11 - RESPONSIBILITY
The Vendor shall not be liable for any indirect damage related to the use of the site or the products. Its liability cannot be engaged in the event of non-performance of contract attributable to the Client, in case of force majeure or by an external party.
ARTICLE 12 – PERSONAL DATA
Personal information collected is processed in accordance with the GDPR and the Data Protection Act and Freedom Law of 6 January 1978. At any time, the Client can exercise his rights of access, rectification, opposition and deletion at the following address: support@enaos.net.
ARTICLE 13 – INTELLECTUAL PROPERTY
All elements of the Site are protected by intellectual property rights. Any unauthorized copying or use of the content is strictly prohibited.
ARTICLE 14 – MEDIATION
In the event of a dispute not resolved by customer service, the customer may call upon a consumption mediator free of charge:

ARTICLE 15 – APPLICABLE LAW AND JURISDICTION
These T&Cs are governed by French law. Any dispute will be submitted to the exclusive jurisdiction of the competent French courts in accordance with common law rules.
